Quick Summary / Abstract: Staff will present a resolution for Board approval, to determine the relative order of termination of certain certificated employees in the event of the layoff of certificated employees.
Background: During layoffs, the Board of Education may establish the order of seniority of employees who have identical seniority dates. Education Code 44955(d)(1) permits a school district to retain junior staff when a district can demonstrate a specific need for personnel to teach a specific course/program. Staff is recommending that the following criteria be used in determining the order of termination based upon the needs of our District and students:

1. Category I - English Learner (EL) Certification
2. Category II - Credential
3. Category III - Experience
4. Category IV - Professional Preparation: Each K-12 teaching and support credential, each clear credential, each K-12 limited supplemental authorization, each Master's degree held, National Board Certification, Doctoral Degree.
5. Category V - Lottery: If any two or more certificated employees who first rendered paid service on the same date still have the same number of points after application of categories I - IV provided above, the ranking of such employees shall be determined by a lottery conducted by the Director of Human Resources or designee.
Status The purpose of this resolution is to determine the relative order of termination of certain certificated employees in the event of the layoff of certificated employees effective at the end of the 2018/2019 school year.
Fiscal Impact There is no impact to the General Fund.
Superintendent's Recommendation: Adopt , by roll call vote, Resolution No. 030-18/19, Specifying Criteria to be Used to Determine the Order of Termination of Certificated Employees with Equal Seniority (Tiebreaker).
